NOCIRA APP PRIVACY POLICY

Nocira, LLC ("Nocira," “we,” “us”) provides the Nocira mobile application (the “App”), a companion to the Nocira AVPI (“Wave”) device used for the treatment and tracking of migraine and headache. This Privacy Policy explains what information the App collects, how we use and share it, and the choices you have.

The App is used by participants in Nocira’s clinical investigation of the AVPI device. Some information is collected and handled under the terms of that investigation and the informed-consent documents you signed to enroll; where those documents and this Policy differ, the study consent governs the study-related data.

1. Information we collect

Account and identity information. Your Patient ID, and — where provided as part of enrollment — your name and phone number. You sign in with your Patient ID; the App does not ask you to create a password.

Profile and demographic information. Gender, date of birth, ZIP code, weight, height, and your typical migraine side. This information is required before a treatment can begin.

Health information. Because the App supports migraine treatment, it collects health data you enter, including:

  • Qualifying-headache questionnaire responses (e.g. wake time, headache onset time, whether you took medication, and the severity of symptoms such as head pain, nausea, light sensitivity, and sound sensitivity);
  • The location and intensity (0–10 pain scores) of your head pain;
  • Your most bothersome symptom;
  • Treatment-session data, including your “better / same / worse” check-in responses, effective treatment time, and the pressure profile delivered by the AVPI device during the session.

Clinical-investigation identifiers. Site ID, protocol ID, participant ID, and your enrollment/treatment-group assignment, used to associate your sessions with the investigation.

Information from the AVPI (Wave) device. When connected over Bluetooth, the App receives device telemetry such as pressure readings, battery level, and firmware version. This is device data, not additional personal information.

Device and technical information. Your phone model, a device identifier, and the App version, used to operate the App and diagnose issues.

The App does not contain third-party advertising or analytics/tracking software, and does not collect your precise geolocation for tracking (see Device permissions below regarding the Bluetooth-scan location permission).

2. How we use information

We use the information above to:

  • Determine whether a headache qualifies for treatment and guide you through a treatment session;
  • Operate the connection to your AVPI device and deliver and monitor therapy;
  • Record treatment sessions and outcomes and sync them to the Nocira cloud;
  • Support the clinical investigation of the AVPI device and related research and regulatory obligations;
  • Provide customer and technical support, and maintain the security and reliability of the App.

3. How we share information

We do not sell your information, and we do not share it with third-party advertisers or analytics providers. We share information only as follows:

  • Study sponsor and investigators. Your study-related data is shared with Nocira and the investigators/sites conducting the investigation, consistent with your informed consent and applicable regulations.
  • Service providers. Vendors that host our cloud infrastructure and provide IT services process data on our behalf under confidentiality obligations.
  • Legal and safety. We may disclose information if required by law or to protect the rights, safety, or property of participants, Nocira, or others.
  • Business transfers. Information may be transferred as part of a merger, acquisition, or sale of assets, subject to this Policy.

4. Data security

Information is transmitted between the App and the Nocira cloud over encrypted connections (HTTPS/TLS). Access to the App requires authentication, and we maintain administrative, technical, and physical safeguards designed to protect your information. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

5. Data retention

We retain personal and health information for as long as needed to provide the App and to meet the record-keeping, scientific, and regulatory requirements of the clinical investigation, after which it is deleted or de-identified. Study-related records may be subject to retention periods set by the study protocol and applicable law.

6. Your choices and rights

You may request access to, correction of, or deletion of your personal information by contacting us using the details in Contact us below. Deletion of study-related data may be limited by the regulatory record-keeping obligations described above. If you withdraw from the study, follow the process in your informed-consent documents.

7. Device permissions

The App requests the following permissions on your phone:

  • Bluetooth — to find and connect to your AVPI (Wave) device and deliver therapy.
  • Location — on some Android versions, the operating system requires the location permission in order to scan for Bluetooth devices. The App uses it only to discover your AVPI device and does not collect or use your geographic location.
  • Notifications — to alert you for time-critical treatment check-ins, including on the lock screen, so a session is not missed.

You can change these permissions in your device settings; disabling Bluetooth or notifications will prevent the App from delivering or completing a treatment.

8. Children’s privacy

The App is intended for adults (18+) participating in the clinical investigation. It is not directed to children, and we do not knowingly collect information from children under 18.

9. Medical disclaimer

The Nocira AVPI is an investigational device, and the App is provided in the context of a clinical investigation. The App does not provide medical advice and is not a substitute for professional medical care. Contact your healthcare provider or study team with any medical questions.

10. Changes to this Policy

We may update this Policy from time to time. We will post the updated version with a new “Last updated” date, and, where required, notify you or seek your consent.
